Agreement to Terms
By downloading, installing, or using the Tr.Ai.N mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
Description of Service
Tr.Ai.N is an AI-powered fitness coaching application that provides:
- Personalized workout plan generation
- Virtual trainer conversations
- Exercise demonstrations
- Nutrition guidance
- Progress tracking
- Goal setting and habit tracking

Not Medical Advice
THE APP DOES NOT PROVIDE MEDICAL ADVICE. The content provided through Tr.Ai.N, including but not limited to workout plans, nutrition suggestions, and trainer responses, is for informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.
Consult Your Physician
BEFORE STARTING ANY EXERCISE PROGRAM, you should consult with a qualified healthcare provider, especially if you:
- Have any pre-existing health conditions
- Are pregnant or nursing
- Have cardiovascular disease or risk factors
- Have musculoskeletal injuries or conditions
- Are taking medications that may affect your ability to exercise
- Have not exercised regularly in the past
- Are over 40 years of age and have been inactive
AI Limitations
The AI trainer in this app:
- Is not a licensed personal trainer, doctor, or healthcare provider
- Cannot see you perform exercises and cannot correct your form
- May occasionally provide inaccurate or inappropriate recommendations
- Cannot respond to medical emergencies
- Should not be relied upon for medical decisions
User Responsibility
You are solely responsible for:
- Your decision to follow any workout or nutrition recommendations
- Using proper form and technique during exercises
- Stopping exercise if you experience pain, dizziness, or discomfort
- Seeking medical attention when needed
- Ensuring exercises are appropriate for your fitness level
Assumption of Risk
YOU ACKNOWLEDGE THAT PHYSICAL EXERCISE INVOLVES INHERENT RISKS, including but not limited to:
- Physical injury (sprains, strains, fractures)
- Cardiovascular events
- Muscle soreness and fatigue
- Aggravation of pre-existing conditions
By using this App, you voluntarily assume all such risks and release Opolo AI Labs LLC, its officers, members, employees, contractors, and affiliates from any liability related to your use of the fitness recommendations provided.
Not for Emergencies
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. Do not use this App to seek emergency medical assistance.
Eligibility
You must be at least 17 years old to use Tr.Ai.N. We verify age via date of birth collection during onboarding. Users who do not meet the minimum age requirement will be blocked from using the App. Misrepresenting your age violates these Terms and may result in account termination.
User Accounts
Currently, Tr.Ai.N does not require user accounts or registration. All data is stored locally on your device.
Acceptable Use
You agree NOT to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or hack the App
- Circumvent rate limits or abuse the AI service
- Use the App to generate harmful, abusive, or inappropriate content
- Misrepresent AI-generated content as professional medical or fitness advice
- Share your AI conversations in ways that could mislead others about the source
Subscriptions and Payments
Tr.Ai.N may offer paid subscriptions in the future. When subscription functionality is available:
- Subscriptions are sold through Apple's App Store and billed to your Apple ID
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
- To cancel, go to iOS Settings > [your name] > Subscriptions
- Refunds are handled by Apple per Apple's standard refund policy
- Subscription tiers, pricing, and features may change with notice
- Cancellation does not delete your locally stored data
Intellectual Property
Our Property
The App, including its code, design, content, AI systems, and branding, is owned by Opolo AI Labs LLC (operator of Tr.Ai.N) and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
Your Content
You retain ownership of any content you create within the App (workout notes, goals, etc.). By using the App, you grant us a limited license to process this content to provide the service.
AI-Generated Content
Workout plans and trainer responses are generated by AI. While we strive for quality, we do not guarantee the accuracy, completeness, or suitability of AI-generated content for your specific situation.
Third-Party Services
The App uses third-party services including:
- Anthropic Claude: For AI conversations
- ExerciseDB: For exercise demonstrations
Your use of these services is subject to their respective terms and policies.
Disclaimers
"As Is" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY OF CONTENT.
No Guarantee of Results
We do not guarantee any specific fitness results from using the App. Results vary based on individual factors including genetics, effort, consistency, nutrition, and other lifestyle factors.
Service Availability
We do not guarantee uninterrupted access to the App or AI services. The service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: personal injury or health issues arising from exercise, loss of data, loss of profits or revenue, or emotional distress.
OUR TOTAL LIABILITY for any claims arising from your use of the App shall not exceed the greater of (a) the amount you paid for the App or subscriptions in the 12 months preceding the claim, or (b) $50 USD.
SOME JURISDICTIONS do not allow limitations on liability, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Opolo AI Labs LLC, its officers, members, employees, contractors, affiliates, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any injury to yourself or others resulting from following App recommendations
Changes to Terms
We may modify these Terms at any time. Changes will be effective when posted in the App or on our website. Your continued use of the App after changes constitutes acceptance of the new Terms.
We will provide notice of significant changes through:
- In-app notifications
- Updated "Last Updated" date
Termination
You may stop using the App at any time by deleting it from your device.
We reserve the right to:
- Modify or discontinue the App at any time
- Block access to users who violate these Terms
- Update rate limits or feature availability
Governing Law
These Terms are governed by the laws of Texas, United States, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through:
- Informal Resolution: Contact us first to attempt to resolve the dispute
- Binding Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration
- No Class Actions: You agree to resolve disputes individually, not as part of a class action
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tr.Ai.N regarding your use of the App.
